PRIVACY AND PERSONAL DATA PROTECTION POLICY

FENTECH (hereinafter “FENTECH” or the “Company”) publishes the website accessible via the URL https://fentech.ai (hereinafter the “Site”) and the intelligent sales forecasting solution Clairvoyant (hereinafter “Clairvoyant”, “D-Sales” or the “Solution”).

In this context, FENTECH may process personal data collected from any adult natural person browsing the Site (hereinafter the “User(s)”):
– accessing and filling out contact forms, requests for demonstrations, subscription to the newsletter and making appointments; Or
– creating an account for the use of the Clairvoyant smart solution.

FENTECH takes respect for privacy and the protection of personal data very seriously. This is why FENTECH, as data controller, works and undertakes to protect the privacy and personal data of Users in accordance with legal requirements and in particular Regulation No. 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter “General Data Protection Regulation” or “RGPD”) and Law No. 78-17 of January 6, 1978 relating to data processing, files and freedoms (hereinafter “Data Processing and Freedoms Law”).

The purpose of this privacy policy (hereinafter the “Privacy Policy”) is to inform Users of the Site as well as possible of the way in which FENTECH protects the personal data it collects in the context of the use of the Site and of the commitments made by FENTECH in order to ensure compliance with the personal data of Users.

By providing personal data when using the Site, the User acknowledges having read the terms of the Privacy Policy.

A – WHAT DATA ARE PROCESSED BY FENTECH AND FOR WHAT PURPOSES ?

FENTECH processes the personal data of Site Users for the sole purposes set out in the Privacy Policy.

As data controller, FENTECH processes Users’ personal data in a lawful, fair and transparent manner. The main purpose of collecting personal data is to provide Users with a safe, optimal, efficient and personalized experience.

The data processed by FENTECH is collected directly from the User for the purposes of managing the Site published by FENTECH.

The data requested when creating the account is mandatory. Otherwise, it is not possible to connect. Where applicable, the mandatory or optional nature of the data collected and the possible consequences of a lack of response are specified at the time of collection.

The different categories of personal data collected by FENTECH, the use made of them and the legal basis to justify the processing and therefore to make it lawful and fair are presented below.

FENTECH, as data controller, uses your data to:

  • Legitimate interest:
  • improvement of navigation on the Site;
  • produce statistics of audiences and use of online services;
  • creation of a FENTECH account;
  • conduct communication campaigns (newsletter);
  • ensure the security of the Site;
  • guarantee the defense of FENTECH’s rights.

The data processed by FENTECH is collected directly from the User of the Solution for the purpose of providing the Clairvoyant sales forecasting solution.

The data requested when creating the account is mandatory. Otherwise, it is not possible to connect. Where applicable, the mandatory or optional nature of the data collected and the possible consequences of a lack of response are specified at the time of collection.

FENTECH, as data controller, uses your data to:

Execution of pre-contractual and contractual measures:

  • respond to your requests in connection with the use of the Solution;
  • creation of your profile;
  • provision of the Solution and management of its proper functioning.

 

Legitimate interest:

  • improvement of the Solution;
  • production of statistics;
    marketing of the Solution;
  • ensure the security of the Solution;
    providing, supporting and improving the Site;
  • guarantee the defense of FENTECH’s rights.

 

Legal obligations :

  • guarantee the exercise of the rights of Users;
  • management of FENTECH’s accounting obligations.

 

B – HOW LONG DOES FENTECH RETAIN USERS’ PERSONAL DATA?

The data processed for the proper functioning of navigation on the Site (connection data, identification data, logs) and the Solution are kept for a period of six (6) months.

User data used for commercial prospecting purposes (newsletter, demonstration and making appointments) is kept throughout the commercial relationship and then for a period of three (3) years from the last contact unless unsubscription occurs before.

User data collected to respond to contact requests is kept for the time strictly necessary for the processing of the request by FENTECH.

In the event of litigation, FENTECH reserves the right to keep the data that could be useful to it for the duration of the litigation and then place them in a separate archive database for a period of five (5) years after the exhaustion of the remedies.

C – WHAT ARE THE RIGHTS OF USERS OVER THEIR PERSONAL DATA?

In accordance with the RGPD, the User has the following rights over his personal data:

  • a right to information : the User has the right to obtain clear, transparent, understandable and easily accessible information on the way in which FENTECH uses his personal data and on his rights. This is why FENTECH has drafted this Privacy Policy;

 

  • – a right of access : the User has the right to access the personal data that FENTECH has on him (provided that the request is not manifestly unfounded or excessive, in particular because of its repetitive nature), and to obtain a copy;

 

  • – a right of rectification : the User has the right to demand that his personal data be rectified if they are inaccurate or outdated and/or that they be completed if they are incomplete (provided that the request is not manifestly unfounded or excessive, in particular because of its repetitive nature);

 

  • – a right to erasure : in certain cases, the User has the right to obtain the erasure or deletion of his personal data. This is not an absolute right, insofar as FENTECH may be forced to keep the User’s personal data for legal or legitimate reasons;

 

  • – a right to withdraw his consent : at any time, the User may withdraw his consent to receive the FENTECH newsletter, either by clicking on the unsubscribe link provided in each of the newsletters, or by contacting FENTECH directly.

 

  • – a right to limit processing : the User has the right to request that the processing of his personal data be limited, so that FENTECH can keep this data, but cannot use or process it. This right applies in specific circumstances, namely:

 

  • in cases where the accuracy of the personal data is contested by the User. The processing is then limited for a period allowing FENTECH to verify the accuracy of the personal data;

 

  • in cases where the processing is unlawful and the User opposes their erasure and instead demands the limitation of their use;

 

  • in cases where FENTECH no longer needs the personal data for the purposes of processing but these are still necessary for the User for the establishment, exercise or defense of legal rights; And

 

  • in cases where the User has opposed the processing based on the legitimate interests pursued

 

  • – a right of opposition to the processing of his personal data : the User may at any time oppose the processing of his personal data for reasons relating to his particular situation, unless FENTECH asserts legitimate and compelling reasons for the processing of such data which prevails over the interests, rights and freedoms of the User or when such data is necessary for the recognition, exercise or defense of a legal right;

 

  • – a right to data portability : the User has the right to receive the personal data concerning him, which he has provided to FENTECH and which is present in the FENTECH database, in a structured, commonly used and machine-readable format. This only applies to data that the User has provided directly or indirectly, when the processing is based (i) on the User’s consent or on the performance of a contract and (ii) it is carried out using automated processes;

 

  • – a right to define special directives relating to the storage, erasure and communication of your personal data after his death; And

 

  • – a right to file a complaint with a supervisory authority : the User has the right to enter and file a complaint with the Commission Nationale de l’Informatique et des Libertés (CNIL) to contest FENTECH’s practices with regard to the protection of personal data and respect for privacy.

D – WHAT ARE THE DUTIES OF THE USER IN TERMS OF PROTECTION OF PERSONAL DATA?

The User undertakes to ensure, as far as necessary, the updating of the personal data concerning him. The User further agrees that the personal data concerning him is accurate, complete and sincere.

E – WHO ARE THE RECIPIENTS OF USERS’ PERSONAL DATA?

FENTECH undertakes to process User data for its own account and in a confidential manner.

The personal data collected on the Site and the Solution will only be communicated to third parties in certain circumstances and in accordance with the provisions of the RGPD.

Communication of Users’ personal data internally : some of the Users’ personal data is accessible to FENTECH employees if these people need to have access to it for the performance of the purposes mentioned in point B above.

Communication of Users’ personal data to third-party service providers : FENTECH may in particular provide access to Users’ personal data to third-party service providers, acting as subcontractors to perform services relating to the Site and the Solution, hosting services, storage, analysis, communication, data processing, form management, databases or computer maintenance.

These service providers act only on instructions from FENTECH and will only have access to the personal data of Users to perform these aforementioned services and will be bound by the same security and confidentiality obligations as FENTECH.

The data processed by FENTECH is not subject to any transfer and is hosted in France.

F – WHAT HAPPENS IF FENTECH CHANGES THIS PRIVACY POLICY ?

FENTECH may update this Privacy Policy at any time to adapt it to possible new practices and service offers. In this case, the date of update of the Privacy Policy will be updated and will indicate the day on which the modifications were made. If FENTECH updates the Privacy Policy, Users will be notified through the Site.
